Our colleague, Kamal Tserakhau, attended the Digital Dragons games industry conference, one of the largest B2B communities in Europe, held 19-21 of May in Kraków
We share the key legal insights from this prestigious event:
- AI is everywhere for everyone - AI tools are already extensively employed in creating graphics, textures, 3D/2D models, world-building, audio, character design for games, devops, and liveops. The next frontier is the integration of AI directly into games, enabling NPCs to communicate with players using AI rather than pre-written dialogue. Such innovations are already being implemented in some cases.
- However, AI also carries heightened legal risks, particularly:
- IP infringement by output - the AI-generated content may infringe upon third-party intellectual property rights
- IP protection of output requires human authorship - the extent of human investment necessary remains ambiguous in case law, necessitating meticulous documentation of the development process to establish authorship in potential disputes
- Processing of personal data by AI and concerns surrounding automated decision-making
- Confidentiality and trade secret issues, as AI systems inevitably incorporate user data for continued training
- When seeking investments or publishers, indisputable IP ownership without third-party encumbrances, coupled with an experienced team boasting previously shipped titles, is of paramount importance.
- Warranty and Indemnity insurance (W&I) is emerging as a new trend in mergers and acquisitions within the gaming industry. This insurance permits sellers to divest without retaining lingering liabilities, facilitating a cleaner exit while transferring risks to the insurers.
Naturally, the conference encompassed far more than mere legalities. A multitude of inspiring speakers, participants, and a profusion of remarkable studios showcasing awe-inspiring projects enriched the experience.
