Dispute on a contract for the sale of gaming equipment and software

Commercial dispute in the Ad-hoc court in London under UNCITRAL Arbitration Rules in which REVERA represented a major eastern-European company in the field of electronic interactive games against a Polish company.

Representing a company from Germany

Represented the defendant, a German manufacturer of galvanic equipment for nickel plating and chrome plating of products, against a claim for recovery of penalties for late delivery of equipment to a Belarusian company. The case was won in the International Commercial Arbitration Court at the Chamber of Commerce and Industry of the Russian Federation.

Arbitration dispute under a mixed contract

Arbitration dispute under English law in the International Chamber of Commerce - ICC (Paris), where REVERA represented the interests of a large Leisure&Entertainment company from the CIS against an Irish company regarding the recovery of the principal amount of the debt and damages under a mixed contract (supply contract and license agreement). The case was won in favor of the client.

Advertising digital platform

Accompanying a dispute under English law on the side of the plaintiff - an international advertising platform - against a Maltese company under the terms of an online agreement for the provision of SaaS services. The REVERA team helped the plaintiff recover the principal debt and damages.

Domain UDRP Disputes

REVERA developed and implemented a strategy to combat the illegal use of the client's trademarks in 20+ domain names, identified and blocked some domains and initiated UDRP procedures against the remaining domains. The actions of the violators diverted traffic from the client's websites and included elements of phishing.

Online casino operator

Representing a client before the Arbitration Institute of the Stockholm Chamber of Commerce in a case concerning an M&A transaction for the acquisition of an international business structure. The REVERA team initiated arbitration under an accelerated procedure and then achieved a successful settlement of 100% of all claims.

UK Software Developer

Representing a software developer in the Vilnius Court of Commercial Arbitration (VCCA) in a case against a FinTech company from the Netherlands. The defendant was evading payment of debt for software development services, and the claimant insisted on recovery of the principal amount of the debt and interest for the period of delay until the execution of the court decision. The arbitration award was made in favor of the client.

International Venture Fund

Representing a venture fund in the Hong Kong International Arbitration Centre (HKIAC) in a case against a major US game developer regarding non-payment of a loan and an agreed share of profits from game sales in Google Play Market and Apple App Store. The arbitration award was made in favour of the client.

UK-based software developer

Representing a custom software development company in Vilnius Commercial Court of Arbitration (VCCA) in a case against a FinTech company from the Netherlands. The defendant evaded settling the debt for software development services, and the plaintiff insisted on the recovery of the principal debt amount and interest for the period of default until the resolution is executed. The arbitral award was granted in favour of the client.

Trademark registration in Poland in record time

REVERA team ensured the registration of trademarks in Poland under the national procedure. One mark was registered for the product group ‘’glues and adhesives‘’ and the second one for a company in the field of jewellery and watches. Normally, the procedure of trademark registration at the Polish Patent Office takes at least 6 months, but REVERA managed to achieve the result in just four months.

Venture Capital Fund

Representing a venture capital fund in the Hong Kong International Arbitration Centre (HKIAC) in a case against a major US game developer for non-payment of a loan amount and an agreed share of profits from game sales on the Google Play Market and Apple App Store. The arbitral award was granted in favour of the client.

Gambling brand

Representing the client before the Arbitration Institute of the Stockholm Chamber of Commerce in an M&A case involving the acquisition of an international business structure. The REVERA team initiated an SCC emergency arbitration and later managed to get a successful settlement on 100% of all claims.

Support in Trademark portfolio management, including registration, monitoring and protection of client's trademarks in more than 20 jurisdictions.

Andersen

When registering a trademark, the client faced a refusal from the USPTO due to the existence of previously registered marks of other companies. REVERA helped the client to negotiate with other right holders and to prepare and sign coexistence agreements with them.

Domain disputes under UDRP

REVERA worked out and implemented the strategy to combat illegal utilization of the client’s TMs in 20+ domain names, revealed and blocked some of the domains, and initiated UDRP procedures against the rest of the domains. The actions of the perpetrators distracted traffic from the client's websites and involved elements of phishing.

AgroTech Startup

Trademark registration in several regions, including Europe, as well as ensuring the protection of the client's confidential information when working with partners and subcontractors. The implementation of the REVERA's strategy helped the startup to strengthen its position as a leader in the AgroTech sector and secure its top-notch technology.

Digital advertising platform

Advising the plaintiff - an international advertising platform - in a dispute under English law against a company from Malta regarding the terms of online SaaS Terms of Service. REVERA team helped the plaintiff to recover the principal debt and damages.

Fintech and AI solutions developer

REVERA’s advice included conducting IP due diligence, supporting the transfer of IP rights within the corporate structures and unifying intellectual property rights agreements with developers and counterparties.

Arbitration dispute under the hybrid contract

Arbitration dispute under English law at the International Chamber of Commerce (Paris), where REVERA represented a major Leisure & Entertainment company from the CIS against an Irish company for recovery of the principal debt and damages under a hybrid contract (supply and licence agreement). The case was won in favour of the client.

Countering a cyber-squatter attack

A series of disputes between a Maltese gambling company and a cybersquatter about the unauthorized use of the trademarks and trade name in the digital environment. The cybersquatter actively resisted actions to block illegal materias, and attempted to spread defamatory statements about the client. REVERA worked out an anti-cybersquatting strategy, protected the Maltese company's IP, blocked fake accounts and sites, and removed defamatory publications.

Portable radiation detector with exclusive software

REVERA filed an international trademark application, and amended the address of the applicant for the underlying EU and US trademark application. REVERA managed to file an application with preservation of conventional priority, in countries with complicated procedures (Canada, Japan, Australia, India, China).

Software for remote work

Advice on setting up the business in Poland and employing staff who are residents of different countries. REVERA Polska also helped the client with the transfer of IP rights to their main assets, and formalizing relations with their employees and contractors taking into account the purpose of organizing the safe work of the team with IP. As a result, the client has become a well-operated Polish business ready to raise the funds from several investors.

Growing gambling business

REVERA Polska helped the client to protect their brand name and the names of their slots. The difficulty with this project was that the client mostly used very risky names in terms of absolute grounds of refusal. However, they could not quit using these names since they were very catchy from a marketing point of view.

A studio that creates multiplayer online games

A trademark and passing-off dispute between the client and a top-level UK gamedev company in relation to the game released on Google Play Market and Apple App Store. REVERA helped the client to protect its game and TM from the claims and to initiate a counter-offensive against TMs owned by the UK company. REVERA conducted negotiations with the UK company to reach a coexistence settlement.

UK-based Game Publisher

A large-scale dispute between the UK-based Game Publisher and the UK-based Game Studio concerning multiple agreements, including publishing agreement, investment agreement, license agreement, and other related contracts. The dispute revolves around the ownership of intellectual property rights for a game developed for PC, PlayStation 5, and Xbox platforms. REVERA represented the Game Publisher in the arbitral proceedings in the Stockholm Chamber of Commerce (SCC), in negotiations between the parties, and in the proceedings in the courts of the UK.

Mobile game developer and publisher from Cyprus

REVERA assisted them with the protection of their brand name, as well as their game design when violated by the competitors. The team of REVERA has submitted various claims within marketplace platforms, and managed to block the materials that violate the rights of the client

SEO-solutions developer

The client received a few letters from third parties where they raised their concern about the mechanics of the clients’ products, especially whether the client violates their rights when crawling. REVERA audited the client’s product from the legal point of view and highlighted the risky points (the ones that may potentially result in violation).

Online entertainment brand

Complex trademark and copyright dispute between Maltese gambling company and American holder of the IP rights about one of the most famous singers in the world. The Maltese company has launched its new game with several references to the mentioned signer and applied for trademark registration in several jurisdictions, which triggered an American company to initiate claims and TM oppositions against it. REVERA worked out and implemented the strategy to protect Maltese company’s rights from the claims and opposition of an American company.

IT company with offices in 17 countries worldwide

Legal support was needed for the company's entry into the new jurisdictions, including Georgia, Cyprus, Poland, and Kazakhstan. Assistance to new R&D centers on corporate and tax issues. The opinions on special regimes for IT businesses in Kazakhstan (Astana Hub), Russia (Skolkovo, Innopolis), and the UAE (free zones) have been provided to enable the company to be successfull in new market entry.
